MINUTES <br />PLANNING COMMISSION <br />SEPTEMBER 9, 2010 <br />that his outdoor storage use of the property should be grandfathered given <br />it existed at the time of the rezoning. <br />The City Planner reviewed the history of the City's rezoning of the area, <br />noting that properties abutting South Owasso Blvd. were rezoned to I -P, <br />properties considered to be part of Ryan Industrial Park retained their I -1 <br />zoning, and a portion of the former Frattalone property abutting South <br />Owasso Blvd. was also rezoned to I -P while a portion of this same site <br />remained I -1. <br />The Planner noted that a couple of years ago the City changed the <br />standards for outdoor storage in the I -P District and reduced the amount of <br />outdoor storage allowed. The Planner indicated that the outdoor storage <br />on this parcel is in compliance with 1 -1 District standards, but not 1 -P <br />District standards. He further noted that the building on the site is of <br />metal construction which complies with the 1 -1 District while the I -P <br />District required masonry construction. The Planner noted that there are a <br />lot of non- conformities on this site to 1 -P standards. A rezoning of the <br />property to 1 -1 would eliminate most of these non - conformities. The <br />Planner further pointed out that the property abuts 1 -1 zoning on three <br />sites. <br />Knudsen asked if approval of the request would cause the City any issues <br />with precedent. The Planner indicated that zoning is a discretionary act <br />and he foresaw no precedent concerns. <br />The City Planner noted that the issues raised in his report relate the <br />outdoor storage to the current I -P zoning of the property. If rezoned to 1 -1, <br />the property will comply with nearly all of the outdoor storage conditions <br />for that zoning district. The primary violation is the existence of an old <br />office trailer at the back of the property. The Planner indicated that this is <br />not an eligible storage item. <br />Duray asked if Mr. Nielsen would he willing to remove the trailer. <br />Nielsen indicated that he uses it for storage, but would remove it if he was <br />required to. Duray also noted the Planner's recommendation for a new <br />site plan so that staff can verify compliance with the conditions listed in <br />his report. The City Planner informed Mr. Nielsen that he or the Code <br />Enforcement Officer could assist him with preparation of that site plan. It <br />should be submitted prior to the City Council meeting on September 20, <br />2010. <br />Nielsen asked if he would be required to screen the entire outdoor storage <br />area. The Planner noted that only the view from the street would be <br />required to be screened. <br />- 3 - <br />18 <br />
