AN ORDINANCE AMENDING CHAPTER 802 <br />OF THE LITTLE CANADA CITY CODE RELATING TO <br />TOBACCO PRODUCTS <br />THE CITY COUNCIL OF THE CITY OF LITTLE CANADA, MINNESOTA <br />ORDAINS: Chapter 802 of the Little Canada City Code is amended as follows: <br />Section 1 <br />Add the following definitions to the text of Section 802.010: <br />(d) "Tobacco Store" means a retail establishment with an entrance door <br />opening directly to the outside that derives more than 90 percent of its <br />gross revenue from the sale of cigars, cigarettes, loose tobacco cigarette <br />or cigar lighters and tobacco - related devices and in which the sale of <br />other products is merely incidental. This definition does not include a <br />tobacco department or section of any business establishment with any <br />other kind of liquor food or restaurant license. <br />(e) "Tobacco- related device" means any tobacco product as well as a pipe, <br />rolling papers, ashtray or other device intentionally designed or intended <br />to be used in a manner which enables the chewing, sniffing or smoking of <br />tobacco or tobacco products. <br />(I) "Sampling" means the lighting and burning of a small amount of tobacco <br />(g) <br />by an employee of a Tobacco Store for the sole purpose of allowing a <br />customer or customers to sample the tobacco prior to purchase. A <br />"sample" quantity is an amount of tobacco reasonably calculated to burn <br />for no more than two (2) minutes; for pre - packaged products, %4 of a cigar, <br />or % of a cigarette. <br />"Compliance Checks" are the system the city uses to investigate and <br />ensure that those authorized to sell tobacco, tobacco products, tobacco - <br />related devices, and nicotine or lobelia delivery devices are following and <br />complying with the requirements of this ordinance. Compliance checks <br />shall involve the use of minors as authorized by this ordinance, <br />Compliance checks shall also mean the use of minors who attempt to <br />purchase tobacco tobacco products tobacco- related devices, or nicotine <br />or lobelia delivery devices for educational, research and training purposes <br />as authorized by state and federal laws. Compliance checks may also be <br />conducted by other units of government for the purpose of enforcing <br />appropriate federal state or local laws and regulations relating to tobacco, <br />tobacco products, tobacco- related devices, and nicotine or lobelia delivery <br />devices. <br />1 <br />
