MINUTES <br />CITY COUNCIL <br />MAY 11, 2011 <br />from hanging around the store, the City has other controls in place to <br />address that situation. <br />Keis asked if most cities have proximity restrictions. The City Attorney <br />noted that the City of St. Paul has proximity restrictions with pawn shops. <br />It is also typical to have these restrictions in place for businesses such as <br />check - cashing shops. These restrictions are typically put in place when a <br />city does not want to see an area concentrated in a certain type of business. <br />The Council again referred to the map of existing tobacco license <br />locations in the City, and it was noted that as the proximity restriction is <br />proposed, there may be no locations that could comply with that <br />restriction. The Administrator noted the location of North Heights <br />Lutheran Church on the Roseville side of Rice Street. McGraw asked if <br />the City had the ability to put a proximity restriction in place taking into <br />consideration the uses in an adjacent city. The City Attorney replied that <br />it could. <br />The City Attorney noted that the City does have some proximity <br />restrictions in its ordinances, specifically that a liquor license cannot be <br />issued for a premises located within 800 feet of any school building or <br />church in the City. The City Administrator noted another restriction that <br />pawn shops cannot be within 300 feet of any church or school. <br />Blesener again stated his support for a 500 foot proximity restriction as <br />stated in the ordinance amendment that would apply to tobacco stores <br />only. He noted that additional issues of contention with the existing <br />tobacco stores will be the proposed hours of operation and the 15% <br />limitation on product display area used for display or storage of tobacco - <br />related devices. <br />The consensus of the Council was in support of the 500 foot proximity <br />restriction for tobacco stores only. The City Council directed the City <br />Attorney to make this change to the proposed ordinance. The ordinance <br />amendment will be scheduled for action at the Council's May 25th <br />meeting, and current tobacco license holders will be sent a notice of the <br />meeting as well as a copy of the proposed ordinance. The Council asked <br />that the Sheriff's Department and the Tobacco Coalition be asked to <br />comment on the proposed amendment. <br />LIQUOR The City Clerk reviewed the changes proposed by City staff relative to <br />ORDINANCE an update of the City's Liquor Ordinances.
