days to remove personal items from the property prior to the entry of <br />City's agent(s) to begin work. The notice will be personally delivered to <br />you or attached to the front door of the dwelling within 24 hours of the <br />City's determination of non - compliance. <br />b. Owner hereby grants to City and its agents, the right to enter upon and <br />conduct cleaning operations therein in a manner that will abate the <br />existing fire code violations. Owner shall provide City and /or its agents <br />with a key for access to the property while the abatement process is on <br />going. The key shall be returned within 48 hours of completion of the <br />abatement activity. <br />c. City shall assess the costs of the clean -up activities, together with a 15% <br />administrative fee, against the property described above with such <br />assessment and fee to he spread over a five (5) year period with the first <br />installment due with 2011 property taxes. Interest shall be charged at a <br />five percent (5 %) interest rate for the duration of the assessment. <br />d. Owner hereby waives notice of the assessment hearing for the abatement <br />costs and specifically waives his right to appeal said assessment as <br />provided for in Minnesota Statutes, § 429.081. <br />e. Owner agrees this agreement shall have the same force and effect as a <br />petition presented pursuant to Minnesota Statutes, § 429.031 and <br />specifically waives any public hearings with respect to the abatement. <br />f. Owner has the right to be present during the abatement process, but may <br />not interfere with the work of the City's agent(s). Should there by any <br />question as to the method employed in conducting the abatement <br />operation, the final decision shall rest with the City's agent(s). <br />8. Building Inspection After Clean -Up. The present condition of the property <br />prevented an inspection of the dwelling by the City Building Official for structural integrity <br />and continued compliance with the Minnesota State Building Code. Following the removal <br />of the hazardous condition upon the property, whether by owner or by the City, Owner shall <br />permit the City Building Official to conduct an inspection of structures on the property for <br />structural integrity and compliance with the Building Code. <br />
