days to remove personal items from the property prior to the entry of City's agent(s) to begin work. The notice will be personally delivered to you or attached to the front door of the dwelling within 24 hours of the City's determination of non - compliance. b. Owner hereby grants to City and its agents, the right to enter upon and conduct cleaning operations therein in a manner that will abate the existing fire code violations. Owner shall provide City and /or its agents with a key for access to the property while the abatement process is on going. The key shall be returned within 48 hours of completion of the abatement activity. c. City shall assess the costs of the clean -up activities, together with a 15% administrative fee, against the property described above with such assessment and fee to he spread over a five (5) year period with the first installment due with 2011 property taxes. Interest shall be charged at a five percent (5 %) interest rate for the duration of the assessment. d. Owner hereby waives notice of the assessment hearing for the abatement costs and specifically waives his right to appeal said assessment as provided for in Minnesota Statutes, § 429.081. e. Owner agrees this agreement shall have the same force and effect as a petition presented pursuant to Minnesota Statutes, § 429.031 and specifically waives any public hearings with respect to the abatement. f. Owner has the right to be present during the abatement process, but may not interfere with the work of the City's agent(s). Should there by any question as to the method employed in conducting the abatement operation, the final decision shall rest with the City's agent(s). 8. Building Inspection After Clean -Up. The present condition of the property prevented an inspection of the dwelling by the City Building Official for structural integrity and continued compliance with the Minnesota State Building Code. Following the removal of the hazardous condition upon the property, whether by owner or by the City, Owner shall permit the City Building Official to conduct an inspection of structures on the property for structural integrity and compliance with the Building Code.
