3.4 Successors and Assigns. Any transferee or assignee of all or any part of <br />Mortgagee's interest in this Mortgage shall, from and after the date of such transfer or <br />assignment, replace Mortgagee, as "Mortgagee" hereunder to the extent of the interest acquired <br />by such transferee or assignee. The term "Mortgagee" shall be deemed to include the successors <br />and assigns of any Mortgagee hereunder. <br />Any transferee or assignee of all or part of the Mortgagor's interest in the <br />Mortgaged Property (except any party acquiring a leasehold interest therein) shall, from and after <br />the date of such transfer or assignment, be included in the definition of "Mortgagor" hereunder to <br />the extent of the interest acquired by such transferee or assignee. The terns and conditions of <br />this Mortgage shall bind and inure to the benefit of Mortgagor and Mortgagor's heirs, personal <br />representatives, successors and assigns; provided that nothing contained herein shall be deemed <br />to permit a sale, conveyance, transfer, assignment, lease or mortgage of the Mortgaged Property <br />other than as permitted herein. <br />3.5 Addresses. The headings of the sections contained herein are for convenience only <br />and are not to be construed to be a part of or limit or affect the terms hereof <br />3.7 Waiver of Ri rlhts Regarding Remedies. Mortgagor understands and agrees that if <br />an "Event of Default" (as defined in Section 2.1 of this Mortgage) shall occur, Mortgagee has the <br />right, among others, to foreclose this Mortgage by advertisement pursuant to Minnesota Statutes, <br />Chapter 580, as now in effect or as it may be hereafter amended, or pursuant to any similar or <br />replacement statute hereafter enacted; that under said Chapter 580 as now in effect, if Mortgagee <br />elects to foreclose by advertisement, it may cause the Mortgaged Property, or any part thereof, to <br />14 <br />34 <br />
