Attachment A <br />1 <br />2 City of Roseville <br />3 ORDINANCE NO. <br />4 <br />5 AN ORDINANCE ADDING CHAPTER 410 TO TITLE FOUR OF TIIE <br />6 ROSEVILLE CITY CODE REGULATING THE USE OF COAL TAR BASED <br />7 SEALER PRODUCTS WITHIN THE CITY OF ROSEVILLE, MINNESOTA <br />8 <br />9 THE CITY OF ROSEVILLE ORDAINS: <br />10 <br />11 SECTION 1: Chapter 410 is hereby added to Title Four of the Roseville City <br />l2 Code: <br />13 <br />14 SECTION: <br />15 410.01: Purpose <br />16 410.02: Definitions <br />17 410.03: Prohibitions <br />18 410.04: Exemption <br />19 410.05: Asphalt -Based Sealcoat Products <br />20 410,06: Penalty <br />21 410.07: Severability <br />22 410.01: PURPOSE <br />23 The City of Roseville understands that lakes, rivers, streams and other bodies of water are natural <br />24 assets which enhance the environmental, recreational, cultural and economic resources and <br />25 contribute to the general health and welfare of the community. The City of Roseville <br />26 Comprehensive Plan supports protection of' these resources. <br />27 <br />28 The use of sealers on asphalt driveways is a common practice. However, scientific studies on the <br />29 use of driveway sealers have demonstrated an adverse relationship between stormwater runoff <br />30 and certain health and environmental concerns. <br />31 <br />32 The purpose of this ordinance is to regulate the use of sealer products within the City of <br />33 Roseville, in order to protect, restore, and preserve the quality of its waters. <br />34 410.02: DEFINITIONS <br />35 Except as otherwise provided or clearly implied by context, all terms shall be given their <br />36 commonly accepted definitions. For the purpose of this ordinance, the following definitions <br />37 shall apply unless the context clearly indicates or requires a different meaning. <br />38 ASPHALT -BASED SEALER: A petroleum -based sealer material that is commonly used on <br />39 driveways, parking lots, and other surfaces and which does not contain coal tar. <br />40 COAL TAR SEALER: A coal tar based sealer is a black liquid containing coal tar pitch that is <br />41 sprayed or painted on asphalt parking lots and driveways. <br />15 <br />
