MINUTES <br />CITY COUNCIL <br />JULY 13, 2011 <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />AT & T CELL The City Administrator stated that as the Council is aware, AT & T has <br />TOWER requested that the City sign an Owner's Consent allowing them to make <br />LEASE changes to their antennas that are on the City's water tower. Given that <br />REVISION the antenna size is being increased, the City has the opportunity to try to <br />renegotiate terms of the current lease agreement. The Administrator <br />pointed out that AT & T is in the process of purchasing T Mobile, also a <br />leaseholder on the City's water tower. When the merger occurs, the City <br />will likely lose the T Mobile lease revenue. Therefore, the Administrator <br />has been in discussions with AT & T about an increase in the tower lease <br />rate of approximately $500 per month. The Administrator indicated that it <br />will not be possible to protect the City's full revenue stream. <br />The Administrator reported that the AT & T representative he has been <br />dealing with will he presenting this request to AT & T management. The <br />Administrator indicated that he will keep the Council informed of any <br />progress in this area. <br />COAL TAR The City Administrator reported that the neighboring cities have adopted <br />BASED an ordinance prohibiting the use of coal tar based sealers. The reason for <br />SEALANTS adopting this restriction is related to pollutants contained in this type of <br />sealer. Polycyclic Aromatic Hydrocarbons (PAHs) have been found in <br />concentrations sufficient to require the removal of sediment to be treated <br />as "hazardous materials" thereby increasing disposal costs. PAHs are also <br />believed to be harmful to fish and pose a cancer risk to humans with <br />prolonged exposure. <br />The Administrator reported that the Minnesota Pollution Control Agency <br />(MPCA) is promoting this prohibition by making it a condition of <br />eligibility for grant funding that can be used to offset the cost of pond <br />maintenance when testing shows high PAHs in the pond sediment. The <br />MPCA and the League of MN Cities have prepared a model ordinance to <br />assist cities considering this prohibition. <br />The Administrator reported that the Watershed has indicated that most <br />retailers in MN do not sell products with PAHs, however, small driveway <br />sealing companies use this product. According to the Watershed, this <br />issue was before the Legislature, but they did not enact legislation banning <br />this type of sealer because they did not want to burden retailers with the <br />duty of policing the issue.
