MINUTES CITY COUNCIL JULY 27, 2011 The City Planner indicated that in the case of 209 Ryan Drive, the property is very shallow and there is almost no rear yard in which storage could occur. He also noted the vandalism and security issues raised by Mr. Stanke. The Planner noted that the Planning Commission felt that the appropriate criteria was met to justify the Variance and noted the findings in support of the Variance as outlined in staff's report dated July 8, 2011. Mr. Stanke appeared before the Council and asked if they were aware of the change in Statute relative to Variances. The Council replied that they were. Stanke reported that the trailer is a necessary part of his professional race car operation and the trailer is used for storage of expensive equipment and tools. Stanke indicated that security is a very important component of the request for the Variance. He also pointed out that the trailer would be in the front yard on a seasonal based from April 15th through October 15"'. Stanke described the racing operation which occurs all over the country. Keis asked about the motors and car parts being stored on the east side of the building that the Code Enforcement Officer noted in her report. Stanke indicated that one of his tenants stored those parts on a short -term basis, and they have since been cleaned up. Stanke also noted the comments relative to landscaping, and noted that last winter was a hard one for these trees. Stanke expected that the trees would recover. There was no one else from the general public present wishing to comment on this matter. Upon motion by Keis, seconded by McGraw, the public hearing was closed. Montour introduced the following resolution and moved its adoption: RESOLUTION NO. 2011 -7 -139 — APPROVING A VARIANCE FROM THE FRONT YARD SETBACK REQUIREMENTS TO ALLOW THE OUTDOOR STORAGE OFA LARGE TRAILER IN THE FRONT YARD ONA SEASONAL BASIS FOR 209 RYAN DRIVE, ROGER STANKE, AS WELL AS APPROVAL OF PROOF OF PARKING FOR THIS PROPERTY, SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS OF THE CODE ENFORCEMENT OFFICER AS OUTLINED IN HER JULY 8, 2011 REPORT, BASED ON THE FOLLOWING FINDINGS OF FACT: 1.
