6. Area does not take up parking space as required for conformity to this Ordinance. <br />7. The provisions of Section 921.010.0 of this Ordinance are considered and <br />satisfactorily met. <br />8. No outdoor storage area shall include storage of materials that are considered <br />hazardous materials by the Minnesota Pollution Control Agency. <br />9. No outdoor storage shall be permitted in any yard except the rear yard of the <br />property. In any yard, no outdoor storage area in the 1 -P, Industrial Park District, <br />shall be closer to any property line than ten (10) feet. <br />In addition, the City is considering an amendment to this language relating to the use of <br />storage containers in the I -P district, pursuant to this CUP application. The staffs <br />proposed ordinance in that regard is as follows: <br />a. Containers shall be those manufactured expressly for the purpose of <br />storing and /or shipping materials. <br />b. No container; for the purpose of this ordinance, shall be greater than forty (40) <br />feet in length, eight (8) feet in width, or eight and one half (8.5) feet in height. <br />c. No more than one (1) such container may be allowed for each fifteen thousand <br />(15,000) square feet of lot area. <br />d. Containers shall not be stacked or arranged to exceed the eight and one -half <br />(8.5) foot height. <br />e. Containers shall be painted to match or be complementary in color to the <br />principal building, and shall be maintained to avoid rusting or other visible <br />deterioration of the container. <br />f. There shall be no storage of hazardous materials, as defined by the zoning <br />ordinance Section 902 of this Ordinance, within any such container. <br />In this application, the proposed storage container (currently existing on the site) would <br />be 320 square feet. Applying the requirements of the existing and proposed language, <br />the applicant would be permitted 500 square feet of outdoor storage based on the <br />building size, or 3,500 square feet of storage based on the lot size, whichever is less <br />(thus, a maximum storage area of 500 square feet). The ordinance would, as a part of <br />this storage area, allow up to 2 shipping containers, provided that they meet the <br />requirements of the this code. <br />Therefore, the single container at 320 square feet would be permissible. As noted, this <br />would consume most of the applicant's eligible outdoor storage. Photographs of the site <br />indicate other materials that would need to be placed within the existing buildings or the <br />container, or a new accessory building configuration would need be proposed. <br />The container location can only be viewed down the existing driveway of the site. <br />Provided the container is maintained as required, it sits on a paved surface, and other <br />outdoor storage is removed, it would appear that the applicant can meet the <br />requirements of the ordinance. An inspection of the premises should be conducted to <br />verify compliance with these standards. <br />Summary and Recommendation <br />Provided the applicant can verify compliance with the terms of the current ordinance, as <br />well as any allowance for shipping containers adopted by the City Council, planning <br />6 <br />
