Subject to the development of a policy for forfeitures to be approved by the <br />City Council, process and present forfeiture cases on behalf of the City's law <br />enforcement agency pursuant to said policy. <br />4. Provide an annual report to the City Council on prosecution activities <br />conducted in the name of the City. <br />2. Compensation. (a) Kelly & Fawcett, P.A. will submit monthly billing statements for the <br />services it provides to Little Canada under this Agreement. Our firm tracks and bills its time <br />in quarter -hour increments. We will send detailed billing statements which reflect the date, <br />time billed, person performing the work, description of the work performed, and the line item <br />amount. We will submit separate billing statements for civil services and prosecution <br />services. Our compensation for the above services will be as follows: <br />Civil Services <br />Generally, for work on civil matters, Kelly & Fawcett, P.A. will charge an hourly rate of <br />$120.00 per hour for work performed by attorneys, and a rate of $60.00 per hour for work <br />performed by law clerks or paralegals. Attendance by request at public meetings of the <br />City Council, Planning Commission or other bodies of the City shall be billed at a flat <br />rate of $325.00, regardless of the length of the meeting. Kelly & Fawcett agrees to treat <br />Council Workshops immediately preceding normal City Council meetings as a single <br />meeting for billing purposes. <br />Prosecution Services <br />For work on prosecution matters, including civil property forfeitures under the criminal <br />codes, Kelly & Fawcett, P.A. will charge an hourly rate of $100.00 per hour for work <br />performed by attorneys, and a rate of $60.00 per hour for work performed by law clerks <br />or paralegals. Our monthly billing for services will be capped at a total of $5,000.00 in <br />any calendar month. <br />(b) Kelly & Fawcett, P.A. may incur various expenses in providing services on behalf of <br />Little Canada. The City shall reimburse Kelly & Fawcett, P.A. for all out -of- pocket <br />expenses. We have agreed to the following rates for common reimbursable expenses: <br />Photocopies: $.20 per page. <br />Facsimile: $1.00 per page. <br />Postage: current postage rates. <br />Long Distance: As incurred. <br />Mileage: IRS standard mileage rates in effect for the calendar year <br />Other costs incurred in providing services (e.g. service of process, subpoena fees) will be <br />4 <br />
