compensation for diminution in value of the leasehold or the fee of the Property, shall belong to
<br />Landlord, Tenant shall have the right to claim and recover from the condemning authority, but
<br />not from Landlord unless Landlord is the condemning authority, such compensation as may be
<br />separately awarded or recoverable by Tenant on account of any and all damage to Tenant's
<br />business by reason of the taking and for or on account of any cost or loss to which Tenant might
<br />be put in removing and relocating its equipment, personal property, Antenna Facilities, and
<br />leasehold improvements.
<br />11. Indemnification. Tenant agrees to indemnify, defend, and hold harmless Landlord
<br />and its elected officials, officers, employees, agents, and representatives, from and against any
<br />and all claims, costs, losses, expenses, demands, actions, or causes of action, including reasonable
<br />attorney's fees and other costs and expenses of litigation, which may be asserted against or
<br />incurred by Landlord or for which Landlord may be held liable, which arise from the negligence,
<br />willful misconduct, or other fault of Tenant or its employees, agents, or subcontractors in the
<br />performance of this Lease or from the installation, operation, use, maintenance, repair, removal,
<br />or presence of Tenant's Antenna Facilities on the Property and the Tower, and specifically
<br />including the representations and warranties of Paragraph 13(b) of this Lease. Tenant's
<br />obligations to indemnify under this Lease are contingent upon its receiving prompt written notice
<br />of any event giving rise to an obligation to indemnify Landlord and Landlord's granting it the
<br />right to control the defense and settlement of the same.
<br />12. Notices. All notices, requests, demands, and other communications hereunder
<br />shall be in writing and shall be deemed given if personally delivered or mailed, by certified mail,
<br />return receipt requested to the following addresses:

<br />13. Representations and Warranties.
<br />a. Landlord represents that (i) it has full right, power, and authority to execute this
<br />Lease; and (ii) it owns the Property in fee simple; and (iii) it has good and unencumbered title to
<br />the Property free and clear of any liens or mortgages, except as may be disclosed by review of
<br />title. Landlord warrants that Tenant shall have the quiet enjoyment of the Property during the
<br />term of this Lease in accordance with its terms.
<br />b. Tenant represents and warrants that its equipment, personal property, and
<br />Antenna Facilities, and any of their component parts or by- products, do not introduce or use any
<br />hazardous substance, hazardous facility, hazardous waste, pollutant, or contaminant, as any of
<br />those may be defined under federal, state or local laws (collectively, "Hazardous Substance ") in
