Hanson <br />Attached is the draft of the proposed development agreement between the J. W. Moore, Inc. and the City <br />relative to the plat of Moore's Evergreen Hills. This agreement follows standard form with one notable <br />exception. In paragraph #18, I have added a provision to address the likelihood that the Developer will <br />sell lots to other builders. When they do so, their rights and responsibilities on that parcel have changed. <br />So as a condition of the purchase agreement, we are requiring any third party builder to agree to comply <br />with the provisions of Paragraph #18. Should they fail to do so, the purchaser will be acknowledging <br />that the City will withhold the issuance of a certificate of occupancy for the non - compliant parcel. The <br />third party will also be subject to any fines and fees that are associated with non- compliance. <br />The City Attorney has not yet reviewed this document or my modifications to Paragraph #18. Subject to <br />any comments he may have, I would recommend approval as presented. <br />cc: Grant Johnson <br />1 <br />
