EXHIBIT A <br />RESOLUTION <br />FINDING THE EXISTENCE OF A PUBLIC NUISANCE AT 122 DEMONT, UNIT <br />#274 AND ORDERING THE ABATEMENT OF SAME <br />WHEREAS, the City of Little Canada Fire Marshal and Building Official responded to <br />an anonymous complaint regarding Unit 8274 located at 122 Demont within the City of <br />Little Canada; and <br />WHEREAS, upon inspection of the unit a number of serious fire and electrical code <br />violations were found to exist that jeopardized the well being of the occupants of the <br />complex at 122 Demont; and <br />WHEREAS, on January 9, 2008 a notice was provided to the owner of the unit <br />delineating the nature of said violations, declaring the property in question unsafe, and <br />demanding correction of same by February 12, 2008; and <br />WHEREAS, no corrections were made by the owner by February 12, 2008; and <br />WHEREAS, the continued existence of these violations poses a continued safety threat <br />to all of the residents of 122 Demont; <br />NOW, THEREFORE BE IT RESOLVED THAT the City of Little Canada hereby <br />declares the existence of a public nuisance at 122 Demont, Unit #274 and orders the <br />nuisance abated based upon the following actions: <br />1. The required fire- resistance rating of fire- resistance construction (including walls, <br />firestops, partitions, smoke barriers and floors) shall be maintained. Such elements <br />shall be properly repaired, or replaced when damaged, altered, breached or <br />penetrated. <br />a) The sheetrock has been removed from the walls of this unit. This violates <br />the fire rated construction requirements of the building. <br />2. Electrical Equipment, Wiring and I- Iazards Minnesota State Fire Code 605 <br />Identified electrical hazards shall be abated. <br />a) Open junction boxes and wiring splices shall not be permitted. <br />You are required to contact an electrical contactor to repair the wiring in <br />this unit with proper permits and inspections. <br />3. Smoke Alarms - Minnesota State Fire Code 907.2.10.1.2 requires smoke alarm <br />system in this unit. <br />a) Therefore, smoke alarms shall be installed on the ceiling outside each <br />separate sleeping area in the immediate vicinity of the bedrooms. <br />b) A smoke alarm shall be installed in each room used for sleeping purposes. <br />c) All smoke alarms shall be installed per manufactures installation <br />recommendations. <br />7 <br />
