The property is zoned PUD, and was developed as a part of a City - <br />initiated tax increment financing project to provide high quality office and office - <br />warehouse space along I -35E. Over time, a total of four buildings have been built in this <br />area, with future plans for additional redevelopment to the south of the subject property. <br />In the spring of 2007, the applicant requested the ability to construct a detached <br />accessory garage building in the parking lot behind the principal building. The <br />application also includes a request for the construction of a gazebo that would be <br />located in the front parking lot. The purpose of the garage building was to be for <br />storage of company equipment which the applicant indicates is often stored outside. It <br />should be noted that outside storage is not permitted in this district, and there is an <br />existing garage building near the proposed location. The purpose of the gazebo is as a <br />sales display — the applicant markets this product to retail purchasers. <br />The City Council approved amendments to the PUD to allow the display of the gazebo <br />seasonally between March 1 and October 31 of each year, and to allow the construction <br />of a garage, in which the applicant was to be required to keep all storage materials, <br />including room for a dumpster. The applicant had been storing materials and a trash <br />dumpster outside on the parking lot area. <br />During the past 10 months, the gazebo has remained on site past the removal date of <br />October 31, and the applicant has found a potential tenant for a portion of his building. <br />As a result, the applicant is seeking a revised PUD permit for the following purposes: <br />7 <br />
