AGREEMENT BETWEEN <br />CITY OF MAPLEWOOD <br />AND <br />CITY OF LITTLE CANADA <br />SANITARY SEWER USE /CONNECTION AGREEMENT <br />This Agreement, made and entered into this day of , 2008, by <br />the City of Maplewood (hereinafter "Maplewood "), a municipal corporation of the State <br />of Minnesota and the City of Little Canada (hereinafter "Little Canada "), a municipal <br />corporation of the State of Minnesota. <br />RECITALS <br />WHEREAS, a portion of Maplewood's public sanitary sewer system is <br />connected to the Little Canada sanitary sewer system for the purpose of transporting <br />sanitary sewage from Maplewood's Sewer District 12, and the following agreement is <br />intended to ratify the mutual understanding and agreement related to this connection. <br />NOW, THEREFORE, in consideration of the mutual covenants and promises <br />made herein, the parties agree as follows: <br />SECTION 1 <br />TERMS <br />1) Little Canada does hereby ratify Maplewood's sanitary sewer connections <br />from Maplewood's Sewer District 12, to the Little Canada sewer system <br />west of Keller Parkway and south of Palm Court. <br />2) The Maplewood sewer system connected to the Little Canada sewer <br />system shall be used solely for the purpose of conveying sanitary sewage, <br />and Maplewood shall not permit or allow any storm water runoff to enter <br />the sewer system. Additionally, it is understood that Little Canada may <br />conduct periodic metering of flows. If it is determined that Maplewood is <br />contributing inflow /infiltration of storm water into the sanitary sewer <br />system, Maplewood shall take immediate steps to eliminate the <br />inflow /infiltration. Maplewood also agrees to reimburse Little Canada the <br />applicable Metropolitan Council Environmental Services treatment <br />charges associated with the estimated inflow and infiltration generated <br />from sewer lines originating in Maplewood. Maplewood may install a <br />meter in the line immediately prior to Maplewood's flow entering the <br />Little Canada lift stations as the basis for prospective charges. <br />3 <br />
