MINUTES CITY COUNCIL FEBRUARY 28, 2007 The City Administrator indicated that there is no provision for outdoor storage on this site. The Planner indicated that only licensed, operable vehicles can be parked on the site. However, the parking area must be paved. Montreux suggested that enforcement of outdoor storage extend to adjacent properties as well. Montour replied that the City is continuing its code enforcement efforts in this area. There was no one else present from the general public wishing to comment on this matter. Upon motion by McGraw, seconded by Montour, the public hearing was closed. The City Administrator recommended that the Fire Marshal inspect the garage /warehouse space that Mr. Anderson is renting. He noted that this property has not been inspected for some time, and the City had been very patient with Mrs. Trobec in trying to address the condition of this property. Mr. Blesener introduced the following resolution and moved its adoption: RESOLUTION NO. 2007 -2 -46 — APPROVING A PLANNED UNIT DEVELOPMENT PERMIT TO ALLOW AN INTERIM USE OF COMMERCIAL PROPERTY FOR PRIVATE AUTO REPAIR HOBBYIST AT 2968 RICE STREET, THE TROBEC/MONTREUX PROPERTY, SUBJECT TO THE CONDITIONS OUTLINED IN THE CITY PLANNER'S REPORT DA TED FEBRUARY 2, 2007, SUBJECT TO THE INTERIM USE PERMIT NOT BEING ABLE TO BE ASSIGNED TO ANOTHER TENANT OR OWNER OF THE PROPERTY, SUBJECT TO AN INSPECTION OF THE GARAGE/WAREHOUSE BUILDING BY THE CITY'S FIRE MARSHAL,SUBJECT TO THE PROPERTY OWNER HAVING 120 DAYS TO CLEAN UP THE OUTDOOR STORAGE, JUNK, AND DEBRIS THAT EXISTS ON THE SITE, AND SUBJECT TO MS. MARILYN MONTREUX EXECUTING A SIXTY DAY WAIVER RELATIVE TO EXECUTION OF THE INTERIM USE AGREEMENT AS RECOMMENDED BY THE CITY ATTORNEY The foregoing resolution was duly seconded by Montour. Ayes (4). Nays (0). Resolution declared adopted. 8
