ULIERING ..ASSO(IflTtS <br />TAUT: 110M!! <br />Memo <br />TO: Honorable Mayor and City Council Members <br />FROM: Lee Elfering, City Engineer <br />DATE: April 18, 2008 <br />RE: St. Jude Final Plat <br />At the Planning Commission meeting there was a concern raised by a resident of the <br />Oakmont Condominiums in regards to the Jackson Street right -of -way, vacated right -of- <br />way, and ownership of the vacated right -of -way as it relates to the new St. Jude Medical <br />plat. This memo is to help clarify the accuracy of the plat and hopefully answer any <br />questions regarding property ownership. <br />The property line between the St. Jude Medical property and the Oakmont Condominium <br />property is a quarter section line of Section 7. This quarter section line is also the west <br />edge of the existing Jackson Street right -of -way, meaning all of the past or existing right - <br />of -way for Jackson Street was east of the quarter section line. The City had vacated the <br />portion of the Jackson Street right -of -way south of the existing cul -de -sac in the past and <br />that property reverted back to the Oakmont Condominium property. The confusion <br />comes from the fact that St. Jude is dedicating an additional 30 feet of right -of -way for <br />Jackson Street west of the quarter section line of Section 7, and therefore the 30 foot <br />strip south of this new right -of -way is owned by St. Jude and is shown as part of the St. <br />Jude property. It is not the old right -of -way of Jackson Street that was vacated back to <br />the Oakmont Condominium property that lies east of the quarter section line. <br />It should also be noted that prior to recording the plat, Ramsey County will be reviewing <br />and verifying the property ownership of everything within the plat boundary for errors. <br />Therefore the City and Oakmont Condominium can be assured that St. Jude will not be <br />claiming rights to any property it does not own.
