Hanson <br />Attached is a quitclaim deed and a map of outlots (A, C & D) to be donated to the City by the property <br />owners, Mr. Oliver Erickson and Mr. and Mrs. Edwin Drops. Also attached is IRS Form #8283 dealing <br />with a Noncash Charitable Contribution for each parcel. We need to execute a form for each parcel <br />indicating our acceptance of the donation and affirming that if we sell, exchange, or otherwise dispose of <br />the property within three years after receipt, we will file Form 8282, Donee Information Return, with the <br />IRS and give the donor a copy of that form. Our acknowledgement does not constitute agreement with the <br />fair market value claimed by the donor. (Appraisals were submitted documenting the value claimed on the <br />form but I did not include them in the packet given the values are listed on the form and we are not a party <br />to the value being claimed.) <br />Two other issues need to be resolved before we act on the acceptance. The first relates to the inclusion of <br />the environmental warranties that we stated were a condition of our acceptance. (I'll discuss how we <br />should address this with the City Attorney and have an answer by Wednesday's meeting.) <br />The second issue relates to the remaining balance of special assessments from the Viking Drive project <br />assessed last year. Outlots C & D each had $1710.20 levied against them. $171.02 will be paid on each <br />lot as part of taxes for 2008. The remaining balance of $1,539.18 would be due, with interest, over the <br />following nine years. I am confirming the status of the payoff of the assessments with Mr. Dropps. If he <br />wants the City to assume them, you will have to decide if that is appropriate given we did not specifically <br />address this in our past discussions. I will also verify that 2008 real estate taxes have been paid in full. <br />cc: Ed Dropps <br />1 <br />
