MINUTES
CITY COUNCIL
JANUARY 14, 1999
FRATTALONE
RECYCLING
DEVELOPMENT
AGREEMENT
perhaps the solution is to issue citations and let the courts decide these
matters.
Morelan stated that he preferred to lead than push.
Scalze agreed that there should be fair and equitable treatment between
property owners. Scalze suggested that perhaps the best solution would be
to offer all CUP's at a reduced deposit for a period of time.
Fahey agreed and further suggested that, to the extent possible, the Code
Enforcement Officer should conduct the reviews and prepare the reports
on these CUP applications.
Mr. Fahey introduced the following resolution and moved its adoption:
RESOLUTION NO. 99 -1 -6 - ADOPTING THE RECOMMENDATION
OF THE CODE ENFORCEMENT OFFICER WITH REGARD TO
THE PROCESSING OF CONDITIONAL USE PERMIT
APPLICATIONS FOR RYAN INDUSTRIAL PARK WITH THE
ADDITION OF ALL CONDITIONAL USE PERMITS TO BE
PROCESSED AT A REDUCED DEPOSIT UNDER THE SAME
SYSTEM FOR THE FIRST SIX MONTHS OF 1999 CONTINGENT
UPON THE CODE ENFORCEMENT OFFICER'S ABILITY TO
HANDLE THE ADDITIONAL CUP APPLICATIONS
The foregoing resolution was duly seconded by LaValle.
Ayes (5) Fahey, LaValle, Morelan, Pedersen, Scalze.
Nays (0). Resolution declared adopted.
Mayor Fahey noted that the Development Agreement timelines for the
Frattatone recycling operation to cease have expired and Frank Frattalone
is requesting that the Council extend the termination of operation date.
Fahey stated that he supported allowing the recycling business to continue
under some licensing standard rather than amend the ordinance to allow
this type of use. Fahey pointed out that standards for this type of business
could be set up under a licensing arrangement.
Scalze felt that the City needed to be fair to all property owners and that
one property owner cannot be allowed to operate a business that others
could not. Scalze pointed out that the Frattalone recycling operation is
located on eight acres of property. There is only a small building as well
as a temporary mobile office on this property that is not in the best
interests of economic development. Scalze stated that she did not support
allowing the continued operation of a stockpiling and recycling operation
18
