MINUTES <br />CITY COUNCIL <br />JUNE 8, 1999 <br />THERESA <br />BELLO & <br />KATIE <br />KRAMARCZUK <br />DAY <br />FRA -DOR <br />DEVELOPMENT <br />AGREEMENT & <br />LICENSE FEE <br />ORDINANCE <br />In honor of the receipt of the Girl Scout Silver Award, Mayor Fahey <br />and Members of the City Council declared Tuesday, June 8, 1999 as <br />Theresa Bellow and Katie Kramarczuk Day in the City of Little Canada. <br />Mayor Fahey and the Council congratulated Theresa and Katie on their <br />accomplishment. <br />Mayor Fahey opened the public hearing to consider the Interim Use <br />Permit for aggregate materials stockpiling and recycling at Fra -Dor <br />located at 3137 Country Drive. <br />The City Administrator reviewed the fourth amendment of the Frattalone <br />Development Agreement which addresses the terms and conditions for <br />the aggregate materials stockpiling and recycling as an interim use. The <br />Administrator noted that the amendment as proposed would require the <br />posting of a $500,000 bond over the ten -year period the interim use would <br />be allowed. This bond would ensure that stockpiles would be removed <br />and the property restored at the expiration of the interim use. <br />Fahey questioned the necessity of requiring that the full $500,000 be <br />posted over the entire ten -year period. Morelan asked how the $500,000 <br />figure was arrived at. <br />The Administrator reported that Frattalone estimated the cost of removal <br />of the stockpiles at $320,000. Given that removal would be ten years out, <br />the estimate was increased to $500,000. The Administrator indicated that <br />he and Frattalone discussed the option of posting a smaller bond during <br />the initial years of the interim use permit, with that amount to increase at <br />perhaps the 8 -year mark. <br />Morelan asked if there was discussion about shortening the term of the <br />interim use permit. The Administrator replied that there was not given <br />that the ten -year term was a key issue in earlier discussions. <br />Frattalone agreed that the time period for the interim use permit was a key <br />issue and indicated that he is agreeable to a ten -year time period. <br />However, he did have a concern with posting a $500,000 bond for the <br />entire ten -year period, pointing out that this ties up $500,000 of his <br />bondability over the next ten years. Frattalone suggested a $200,000 bond <br />now with the amount to increase to $500,000 at year 8. Frattalone pointed <br />out that the bond will be critical later in the term of the interim use period. <br />The Administrator pointed out that if the bond amount is not increased at <br />year 8, the City could pull the interim permit.
