MINUTES <br />CITY COUNCIL <br />JUNE 8, 1999 <br />Pedersen pointed out that Frattalone has indicated that the use is a good <br />one for the site because of the marginal soils. <br />LaValle noted that there are vacant properties in the City with good soils <br />that are not developing. <br />Fahey stated that his position is that given the track record of Frattalone, <br />the City require a $200,000 bond at this time with the bond amount to <br />increase in the 8°i year. Pedersen pointed out that Frattalone may not <br />continue to be the owner of the property and then the City would be <br />dealing with someone who does not have a proven track record. <br />Scalze suggested that a five -year term for the interim use might be an <br />option. <br />Morelan suggested a laddered amount for the bond over the ten -year <br />period and pointed out that if the amount was not increased as required by <br />the City, the City would have the option for pulling the license. <br />Fahey suggested that this is a viable business that has been run <br />successfully and noted that the City has not received a significant amount <br />of complaints about the business. Fahey indicated that whether or not this <br />business is the highest and best use of the site is not a compelling reason <br />in his consideration of the interim use permit. <br />Pedersen noted that Frattalone has indicated that he cannot build a high - <br />quality building on this site due to soil conditions. This is not prime <br />industrial property. Fahey noted that the Council never developed a <br />consensus on what would be the highest and best use of the site. Pedersen <br />pointed out that when the roads do not hold in this area, it is difficult to <br />expect that this property could develop with a high - quality building. <br />Fahey suggested that the Council reach consensus on the bonding piece. <br />LaValle felt that the $500,000 bond was high for a long -term business <br />owner with a proven track record. Morelan pointed out that the ownership <br />of the business could change. <br />Fahey stated that he would like to see some alternatives. He felt the <br />recommendation of staff for a $500,000 bond was onerous. He suggested <br />that the City Attorney and City Administrator look at alternatives and <br />come back with a recommendation for the Council that will meet <br />everyone's needs. <br />4 <br />45 <br />
