AGREEMENT It is hereby agreed on this of June, 2008 by and between St. John the Evangelist Church of Little Canada and the City of Little Canada, as follows: 1. St. John's School baseball and softball teams shall be granted access to Little Canada fields for team practices and games during the school season, Monday through Friday, prior to 5:30 p.m., as scheduling permits through the Little Canada Parks and recreation Department. 2. The Little Canada Parks and Recreation Department is given exclusive right to use the baseball /softball field at St. John's School for youth softball and youth baseball purposes from April 15 through August 10 of each year. Such exclusive use shall be limited to Monday, Tuesday, Wednesday, and Thursday from 6:00 p.m. until dark as scheduling permits through St. John's Church office. 3. The Little Canada Parks and Recreation Department will be responsible for the issuance of permits, control of parking to keep vehicles on paved parking areas during periods of use, and for the maintenance of the playing field. Such maintenance shall include, but is not limited to infield dragging, lining, and trash removal in preparation for and during the times of use by the City of Little Canada. Mowing and other general maintenance of the turf areas shall remain the responsibility of St. John's. 4. The Little Canada Parks and Recreation Department and the City of Little Canada assume all liability that might arise for damages or injuries that occur to participants or spectators during activities scheduled by Little Canada Parks and Recreation pursuant to this Agreement. 5. Both the City of Little Canada and St. John the Evangelist Church shall obtain certificates of insurance listing one another as additional insureds for the purposes of field use as outlined in this agreement. 6. Each party to this agreement agrees to defend, indemnify, and hold harmless the other, including their respective officers, agents, servants and employees from any claims for loss or damage to property or any injury to or death of any person arising out of or relating to each party's respective acts on the property. Under no circumstances shall the City's obligation under this agreement exceed the municipal liability limits set forth in Minnesota Statutes, Chapter 466. 7. The term of this agreement shall run indefinitely. Either party may terminate this agreement by providing twelve months written notice to the other. ST.
