MINUTES <br />CITY COUNCIL <br />JANUARY 26, 2000 <br />CUP - 3175 <br />RYAN LANE - <br />LEE ROSSOW <br />parcel, it may as well not place any limitations on the number of accesses <br />a property can have. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2000 -1 -15 - APPROVING THE CONDITIONAL <br />USE PERMIT FOR OPEN AND OUTDOOR STORAGE OF <br />MATERIALS AND EQUIPMENT AS AN ACCESSORY USE IN THE <br />SIDE AND REAR YARDS AT 3101 SPRUCE STREET AS <br />REQUESTED BY MR. LEE ROSSOW SUBJECT TO COMPLIANCE <br />WITH THE RECOMMENDATIONS OF THE ZONING <br />ADMINISTRATOR AS OUTLINED IN HER REPORTS DATED <br />JANUARY 5 AND JANUARY 10, 2000, SUBJECT TO ALLOWING <br />THE LANDSCAPE STRUCTURES TO REMAIN IN THE PUBLIC <br />RIGHT -OF -WAY, AND SUBJECT TO THE COMPLIANCE WITH <br />THE CODE REQUIREMENT OF FIVE FOOT GRASSY BUFFER <br />AREAS AT THE PERIMETER OF THE PROPERTY, AND <br />ALLOWING THE FOUR ACCESS POINTS FOR THE SITE AS <br />CURRENTLY EXIST <br />The foregoing resolution was duly seconded by LaV alle. <br />Ayes (3) Fahey, LaValle, Pedersen. <br />Nays (2) Scalze, Morelan. <br />Resolution declared adopted. <br />Mayor Fahey opened the public hearing to consider a Conditional Use <br />Permit for open and outdoor storage of equipment and materials as both a <br />principal and accessory use at 3175 Ryan Lane as requested by Lee <br />Rossow. It was noted that the Planning Commission has recommended <br />approval of the CUP subject to compliance with the recommendations of <br />the Zoning Administrator. <br />Rossow reported that at the Planning Commission meeting he was looking <br />for a definition of construction trailer so that he could comply with the <br />ordinance requirements. Rossow reported that he has discussed this issue <br />with the Zoning Administrator, and agreed to remove the trailer from his <br />property by June 1, 2000. He noted, however, that he is in the <br />construction business and feels that he should be able to have a <br />construction trailer just like any other construction business. Rossow <br />stated that he will move the trailer, however, it will come back to the site. <br />There was no one else from the general public present wishing to <br />comment on this matter. <br />6 <br />
