NORTHWEST ASSOCIATED CONSULTANTS, INC. <br />4800 Olson Memorial Highway, Suite 202, Golden Valley, MN 55422 <br />Telephone: 763.231 .2555 Facsimile: 763.231 .2561 planners(oanacplanning.com <br />MEMORANDUM <br />TO: Little Canada Planning Commission <br />FROM: Stephen Grittman <br />DATE: July 3, 2008 <br />RE: Little Canada — On -Site Sanitation — 95 Woodlyn Avenue <br />Outdoor Storage CUP and Variance for Setback <br />FILE NO: 758.09 — 08.15 <br />Background and Analysis <br />On -Site Sanitation is seeking a Conditional Use Permit for outdoor storage at 95 <br />Woodlyn Avenue, as well as a variance to permit encroachment of the storage area into <br />the setback toward Woodlyn Avenue. The property is currently occupied a building and <br />an extensive storage area. The outdoor storage consists primarily of portable sanitation <br />equipment. The applicants have provided photographs showing the property and <br />existing landscaping, including the existing fence which constitutes the current limit of <br />storage area. The fence and storage area are closer to Woodlyn that the existing <br />building, a violation of the new ordinance that requires all outdoor storage to be behind <br />the front building line. <br />This property has not previously had a Conditional Use Permit, and as such, the <br />encroachment area was not granted any permits — no "grandfathered rights technically <br />apply to the property. <br />Outdoor storage is now allowed by CUP under a revised ordinance. The requirements <br />for the permit are as follows (staff comments inserted in italics): <br />G. Open and Outdoor Storage as an accessory use, provided that: <br />1. The activity of outdoor storage shall require a separate business license <br />issued by the City of Little Canada. The applicant will have to obtain this <br />license. <br />2. The storage area in question occupies an area no greater than sixty percent <br />(60 %) of the gross square footage of the subject parcel. The primary <br />storage area on the east side of the property covers approximately 50% <br />of the lot area. There is additional storage near the main building that <br />
