M. Screening shall consist of masonry walls or fencing constructed of wood <br />or vinyl, as well as landscaping. Metal fencing may be used where <br />landscaping provides a complete year -round screen and is irrigated to <br />ensure survivability in compliance with Section 903.020.F (Fence <br />section). To comply with this requirement, landscaping should be added <br />in front of the fence line to provide the required screening. The existing <br />chain link fence may be used for security, but not screening. A <br />landscaping plan has been submitted that shows a combination of <br />evergreen and deciduous shrubs. The evergreen shrubs are preferred in <br />this case for a year -round screen. <br />11. Waste or recyclable material shall be contained in a refuse container. All <br />such containers shall be stored within a screened enclosure within the rear <br />yard of the property. The applicants should demonstrate the location of <br />the refuse container(s) on a final site plan. <br />12. The storage area shall be paved with asphalt, concrete, or other material <br />approved by the City Council. This condition is met. <br />13. The storage area shall not occupy any space required for conformity to the <br />parking regulations of the Zoning Ordinance. There is substantial <br />parking area within the enclosed portion of the site. The west half of the <br />property is used for buildings and parking. <br />14. The property, including buildings and exterior site areas, shall comply <br />with all applicable fire codes. The fire chief should comment on <br />compliance with this regulation. <br />15. All lighting shall be hooded and so directed that the light source shall not <br />be visible from the public right -of -way or from neighboring residential <br />uses, and shall be in compliance with Section 903.020.I of the Zoning <br />Ordinance. Existing lighting is incidental to the circulation and building <br />lighting already it: place — no new lighting is proposed. <br />16. All other provisions and requirements as deemed necessary by the City <br />Council. <br />17. The applicant complies with the provisions of Section 921 of the Zoning <br />Ordinance. <br />As noted, the applicants are also seeking a variance to permit the encroachment of the <br />storage area into the front yard setback from Woodlyn Avenue. The encroachment is <br />an existing condition, violating the new ordinance by about 20 feet. The applicants <br />make the following arguments in support of their request: <br />• The property was developed prior to the existing prohibition of front yard storage. <br />• Woodlyn Avenue is a dead -end street with a minimal amount of local traffic. <br />® The applicants suggest that decreasing the storage area by the approximately 20 <br />feet would restrict storage area and access needed for their materials and <br />trailers. The applicants state that relocating the storage to another location <br />would create a safety hazard. <br />3 <br />
