Hanson <br />www.ci.little-canada.mn.us <br />MEMORANDUM <br />TO: Mayor Blesener & Members of the City Council <br />FROM: Jessica Jagoe, Code Enforcement Officer <br />DATE: July 18, 2008 <br />RE: 95 Woodlyn Avenue <br />In reviewing the minutes from the Planning Commission meeting on July 10 with regards <br />to On -Site Sanitation, city staff felt it was necessary to address a couple of statements that <br />were made. <br />It is staff's understanding that Dave Holm purchased this property in the early 90's. The <br />use prior to Dave Holm's purchase of the site was not for outdoor storage of portable <br />toilets. As such, there are no grandfathering rights to outdoor storage for their particular <br />use. On -Site currently has outdoor storage on 70 & 95 Woodlyn Avenue. The outdoor <br />storage at both of these sites was established without any Conditional Use Permit <br />approval. <br />In reviewing the address file for 95 Woodlyn Avenue and aerial photos of the property, <br />the fence that is in front of the building staff believes was moved sometime after 1994. <br />Dave Holm submitted a site plan for a property division in 1994 and, at that time, this <br />fence line was not identified. In addition, there is no building permit that was issued for <br />the installation of this fence. During the meeting, the City Planner notes that the <br />permitted fence met the Code at the time it existed and therefore the outdoor storage was <br />grandfathered. Given this fence was never permitted and outdoor storage was established <br />without approval there should be no grandfathering rights to this portion of the site given <br />the uses were not lawfully established. <br />CC: Steve Grittman <br />Dave Holm <br />
