Hanson www.ci.little-canada.mn.us MEMORANDUM TO: Mayor Blesener & Members of the City Council FROM: Jessica Jagoe, Code Enforcement Officer DATE: July 18, 2008 RE: 95 Woodlyn Avenue In reviewing the minutes from the Planning Commission meeting on July 10 with regards to On -Site Sanitation, city staff felt it was necessary to address a couple of statements that were made. It is staff's understanding that Dave Holm purchased this property in the early 90's. The use prior to Dave Holm's purchase of the site was not for outdoor storage of portable toilets. As such, there are no grandfathering rights to outdoor storage for their particular use. On -Site currently has outdoor storage on 70 & 95 Woodlyn Avenue. The outdoor storage at both of these sites was established without any Conditional Use Permit approval. In reviewing the address file for 95 Woodlyn Avenue and aerial photos of the property, the fence that is in front of the building staff believes was moved sometime after 1994. Dave Holm submitted a site plan for a property division in 1994 and, at that time, this fence line was not identified. In addition, there is no building permit that was issued for the installation of this fence. During the meeting, the City Planner notes that the permitted fence met the Code at the time it existed and therefore the outdoor storage was grandfathered. Given this fence was never permitted and outdoor storage was established without approval there should be no grandfathering rights to this portion of the site given the uses were not lawfully established.
