Hanson <br />TO: Mr. David Himmelbach <br />Mr. & Mrs. Gerald Battista <br />FROM: Joel Hanson, City Administrator <br />DATE: February 29, 2008 <br />RE: Land Acquisition for Public Right -of -Way <br />There have been recent development proposals in the vicinity of your property (Richie Place & <br />Canadian Woods). Another parcel could also be considered for development in the not too <br />distant future (Sculley Property). Lastly, the City of Maplewood, in conjunction with the Little <br />Canada, is upgrading the Kohlman Lane /Beam Avenue area by the installation of water main and <br />new streets. We have also asked Maplewood to upgrade sanitary sewer service in this area to <br />give us the potential to provide gravity sewer service to some of the developments previously <br />mentioned. (By doing so, we eliminate the need for lift stations that are expensive to install and <br />maintain.) Therefore, the City is evaluating opportunities for the extension of utilities and <br />roadways to serve these and other properties. <br />Your property is important in this process. Attached is an aerial map depicting the preferred <br />alignment for right -of -way to allow the placement of utilities and a future roadway. (Please <br />understand that depiction is not intended as the only possible configuration. Rather, it was an <br />attempt to show what may be possible in conjunction with the layout of roads, ponding, and <br />utilities given existing knowledge of wetland conditions. Any final subdivision design of your <br />property will need to comply with zoning and subdivision ordinances and will warrant further <br />study.) This location was chosen based on a number of factors including wetland impacts, <br />connection to other roadways, and future development of adjoining parcels. <br />The City would like to acquire the needed right -of -way to make this alignment a reality. If we <br />are successful in acquiring the needed right -of -way, it is possible that utility connections could <br />occur yet this year. <br />Here are the options I have identified to govern an acquisition process: <br />1. Land Owner could donate land for easement. In this case, City would survey the needed <br />property, prepare the necessary legal documents, and handle the recording of the documents <br />including the payment of any recording fees. The City will assess project costs and defer, with <br />20 <br />
