MINUTES CITY COUNCIL MAY 23, 2007 SPRING CLEAN UP DAY TEXT AMENDMENT; CONDITIONAL USE PERMITS — 3201 COUNTRY DRIVE — HOMt FURNTTURE 2930 EDGERTON STREET SUBJECT TO COMPLIA..NCE WITH THE RECOMMENDATIONS OF THE CITY PLANNER AS OUTLINED IN HIS REPORT DATED MAY 3, 2007 The foregoing resolution was duly seconded by Keis. Ayes (5). Nays (0). Resolution declared adopted. Mss Johnson expressed her disappointment to the Council over the discontinuance of Spring Clean-Up Day. Johnson reported that Clean Up Day was very helpful to their large family. Keis noted that each residential property owner in the City can dispose of three bulky items per year as part of the City's organized collection contract. Johnson asked if there were any chance that Clean Up Day would be reinstated. The Council indicated that it would depend on the input that the City receives on this issue. Mayor Blesener opened the Public Hearing to consider the applications of Hom Furniture for Text Amendment allowing furniture retail and other retail uses compatible with furniture sales in the B -W District, Conditional Use Permit for proof of parking, and Conditional Use Permit for a Comprehensive Sign Plan. It was noted that the City Planner and the Planning Commission recommended approval subject to compliance with the City Planner's report dated April 9, 2007, and subject to the City Planner's review and approval of individual uses noted in the Hom Furniture list presented at the Commission meeting. The City Planner reviewed the actions before the Council this evening. Relative to the CUP for proof of parking, the Planner noted that there is more than enough parking on the site to accommodate this use as well as a more intensified use. With regard to the CUP for comprehensive sign plan, the City Planner indicated that the sign plan as presented meets the City Code requirements. He noted that Hom Fumiture initially requested a Variance for sign height, but has since withdrawn that request. With regard to the Text Amendment allowing furniture retail and other retail uses compatible with fumiture sales in the B -W District, the Planner indicated that the applicant is seeking a text amendment given that the building is much larger than necessary to accommodate the Hom Furniture store. The additional retail space would then be rented by Hom Furniture to businesses that are compatible with furniture sales. The Planner noted 4
