Hanson <br />www.ci.little-canada.mn.us <br />MEMORANDUM <br />TO: Mayor Blesener and Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: June 8, 2007 <br />RE: Release of Claim — Former Levitz Property <br />Attached is a letter from Briggs and Morgan requesting that the City execute a Release of <br />Claim relative to the State's condemnation action to acquire a drainage easement <br />covering just over two acres along the western edge of the Levitz property. MN DOT <br />had named the City as an interested party in the easement acquisition given the potential <br />for the MN DOT easement to impact the City's drainage and utility easements. Briggs <br />and Morgan is indicating that it does not appear that the City's easement was <br />significantly impacted by the MN DOT easement. The easement they reference is in the <br />southeast corner of the property and was required for installation of a sanitary sewer line <br />serving the Frador property. It will not be impacted by the ponding area. <br />Staff concurs with Briggs and Morgan's assessment of the situation, and recommends the <br />Council execute the Release of Claim. (In terms of fairness, our easements should not <br />entitle us to compensation as they are not impacted nor located in the area to be <br />acquired.) This will allow the owners of the former Levitz property to collect the <br />settlement funds from the condemnation action. <br />
