o 77. C°ayca%
MAYOR
Bill Blesener
COUNCIL
Rick Montour
Barbara Allan
John Keis
Michael McGraw
515 Little Canada Road, Little Canada, MN 55117 -1600 ADMINISTRATOR
(651) 766 -4029 / FAX: (651) 766 -4048 Joel R. Hanson
www.ci.little-canada.mn.us
MEMORANDUM
TO: Mayor Blesener and Members of the City Council
FROM: Joel Hanson, City Administrator
DATE: June 8, 2007
RE: Release of Claim — Former Levitz Property
Attached is a letter from Briggs and Morgan requesting that the City execute a Release of
Claim relative to the State's condemnation action to acquire a drainage easement
covering just over two acres along the western edge of the Levitz property. MN DOT
had named the City as an interested party in the easement acquisition given the potential
for the MN DOT easement to impact the City's drainage and utility easements. Briggs
and Morgan is indicating that it does not appear that the City's easement was
significantly impacted by the MN DOT easement. The easement they reference is in the
southeast corner of the property and was required for installation of a sanitary sewer line
serving the Frador property. It will not be impacted by the ponding area.
Staff concurs with Briggs and Morgan's assessment of the situation, and recommends the
Council execute the Release of Claim. (In terms of fairness, our easements should not
entitle us to compensation as they are not impacted nor located in the area to be
acquired.) This will allow the owners of the former Levitz property to collect the
settlement funds from the condemnation action.
