Mayor and City Council <br />April 25, 2007 <br />Page 8 <br />Exhibit A <br />Valor Enterprises, Inc. <br />Chronology of Recent Inspection Activity <br />April 25, 2007 <br />In January 16, 2007, the City of Little Canada (the "City ") "red tagged" the industrial property <br />owned by Valor Enterprises, Inc. ( "Valor ") and located at 3165 — 3167 Spruce Street. Despite <br />repeated requests from Valor for the exact basis for the red tag, the City failed to provide any basis <br />for its action until Valor initiated court action. <br />On February 8, 2007, the City finally issued three reports detailing the alleged code violation at the <br />Property: electrical hazards, fire hazards and building code hazards. Those three reports assert a <br />total of approximately 60 violations, although there is significant overlap between the three reports. <br />At the same time, the City also issued an "Imminent Hazard" report. It was these alleged imminent <br />hazards that the City eventually indicated supported its issuance of the red tag. Initially, the City <br />was hesitant to allow Valor into the property to correct the alleged imminent hazards without <br />onerous restrictions. The City eventually issued its corrective work order, requiring Valor correct <br />the imminent hazards. The order lists five claimed "hazards ": 1) improper storage of flammable <br />material, 2) improper installation of a "paint booth ", 3) improper means of egress (claiming debris <br />blocked exits), 4) improper storage of combustibles, and 5) storage of automobile parts on the <br />mezzanine level was unsafe. Based on the order, Valor entered the property to correct the imminent <br />hazards. <br />On March 8, 2007, the City inspected the property to determine if the alleged imminent hazards had <br />been corrected. The property was inspected by deputy fire marshal James Lee, building code <br />official Steve Westerhaus, and Jessica Jagoe. The fire marshal and building code official <br />acknowledged that Valor had done a substantial amount of work and that the alleged violations in <br />the imminent hazard report had been corrected. The red tag was removed. <br />On April 24, 2007, the City conducted a follow -up inspection of the Property. Patrick Sweeney, <br />Jessica Jagoe, James Lee (deputy fire marshal), Steve Westerhaus (building official), and Peter <br />Tokle (electrical inspector) attend the inspection for the City. Lori Peterson and Mike Mergens <br />were present on behalf of Valor. <br />During the inspection Mr. Tokle noted outstanding electrical violations, all of which appear minor. <br />At the time, he was informed the Valor had contracted with King Electric to begin remedying all <br />code violations but they had not completed their work. Mr. Tokle questioned whether a permit had <br />been pulled and seemed to doubt Valor's response that King Electric had done so. Mr. Tokle would <br />not detail the violations before leaving but said Valor could expect a report early next week. It <br />appears, however, that the remaining violations consist of open electric boxes and an incorrect <br />cover on one of the electric panels. There may also be some wiring that needs to be removed. <br />In speaking with Mr. Lee, he seemed unwilling to comment on what fire code violations he believed <br />were outstanding. He did agree, however, that Valor had supplied fully charged fire extinguishers <br />that just need to be mounted at the proper height. Lori Peterson of Valor indicated that the <br />- 2 7 - <br />
