May 10, 2007 <br />Mr. & Mrs. Walter Wegleitner <br />431 Belmont Lane E. <br />Maplewood, MN 55117 <br />RE: Property Acquisition of 91 Viking Drive West <br />PIN #07- 29 -22 -33 -0006 <br />Dear Mr. & Mrs. Wegleitner: <br />By motion of the City Council of the City of Little Canada dated May 9, 2007, I have been <br />authorized to issue you a 1033 letter documenting the fact that while your property was acquired <br />via a voluntary sale, it was done under the threat of eminent domain pursuant to Minn Stat. <br />§117.01 in order to facilitate the relocation of Viking Drive from Rice Street to Minnesota <br />Avenue. Please consider this letter as evidence that your property was acquired under the <br />threat of eminent domain. <br />You should also be advised that pursuant to our purchase agreement, you made certain <br />warranties that survive the closing. Those warranties included the fact that this was a voluntary <br />sale and that no person or persons were being displaced as a result of this acquisition. As such, <br />the City proceeded with this transaction on the assumption that no one was entitled to relocation <br />benefits.
