The shopping center is zoned PUD — Planned Unit Development, <br />which allows permitted and conditional uses from the City's commercial districts. The <br />theatre proposes to occupy a space with relatively limited dinner seating, and would <br />have access to entrance doors from both the front and rear of the Shopping Center. <br />Parking would be available from both locations. The facility would be catered by the <br />Little Venetian, including bar service. <br />The Zoning Ordinance allows theatres as a commercial recreational use, and requires <br />that any such use which includes alcohol service be allowed only by Conditional Use <br />Permit in the B -3 zoning district. The PUD Permit serves as the CUP in such cases. <br />The Planning Commission reviewed the request and recommended approval, with the <br />condition that the applicants provide for direct access to the rear parking lot. Planning <br />staff would add the recommendation that the facility includes directional signage that <br />encourages use of the rear parking lot to avoid parking lot conflicts with the more <br />traditional retail tenants. <br />Summary and Recommendation <br />The proposed dinner theatre is allowed in the zoning district via the PUD permit <br />process.
