H anson MEMORANDUM TO: Members of the Planning Commission FROM: Joel Hanson, City Administrator Jessica Jagoe, Code Enforcement Officer DATE: January 4, 2007 RE: Valor Enterprises Attached is a timeline of events for Valor Enterprises since the revocation of the Conditional Use Permit process was started in May 2006. The City Council revolted the Conditional Use Permit on September 27, 2006 and did not renew the auto outdoor retail sales and auto repair licenses for this property. City Staff continues to spend a tremendous amount of time dealing with this property and /or matters related to this property since the revocation. Staff has become aware of continued storage of cars owned by Valor Enterprises on other businesses property with and without permission. Many of these have resulted in the cars being towed and citations issued. The last inspection on this property conducted by City staff was on Monday, December 26, 2006. Valor was attempting to achieve compliance with the previous CUP that was revoked by the City Council this past September. By demonstrating compliance, Valor believes that would improve their chance for reissuance of their CUP. That CUP allowed a total of 50 cars on site, consisting of 30 "for sale vehicles" and 20 "repairables ". Based on this inspection, Valor would not have achieved compliance under the revoked CUP given he had at least 22 repairable vehicles in the rear yard versus the 20 he was allowed. There were at total of 28 "for sale" vehicles, but they were not stored in accordance with the revolted CUP, The outdoor storage violation of car parts still remained, although was notably cleaner. City staff recommends denial of the text amendment, CUP's, and license applications for Valor Enterprises given this business's demonstrated inability to achieve and maintain compliance with previous CUP requirements and various city codes.
