Memo <br />zirniNG -ASSO(I-11TES <br />TIDE 11001 <br />TO: Honorable Mayor and City Council Members <br />FROM: Lee Elfering, City Engineer <br />DATE: April 11, 2007 <br />RE: Calling of the Boss Road Assessment Hearing <br />Bids were opened today for the Little Canada 2007 Street & Utility Improvements <br />project, which included the construction of Boss Road. This new road is an extension of <br />Bryan Street and runs parallel with the railroad right -of -way. It was determined by City <br />Council at the time the plans were ordered, that an assessment hearing would be held <br />prior to award of the 2007 Street & Utility Improvements project to determine if the <br />assessable costs would be accepted by the benefiting properties. <br />An exhibit depicting the proposed street improvements for Boss Road that were bid in <br />the contract documents is attached to this memo. Please note that the street <br />construction includes the removal of the existing nonconforming cul -de -sac on the end of <br />Bryan Street. It is our recommendation that the improvement include removal of the <br />nonconforming cul -de -sac and construction of a new roadway for a uniform street <br />extension. Our recommendation is based on two factors. The first factor is to ensure <br />proper drainage of the new road, The second is that the removal of the cul -de -sac would <br />be a requirement that we would impose on a developer if the project were done <br />privately. The improvement will benefit a portion of the two lots adjacent to the end of <br />Bryan Street. Council will need to determine if this benefit should be assessed to the <br />benefiting Bryan Street properties at this time, in the future (when the rest of Bryan <br />Street is improved), or not at all. If Council decides not to assess the benefiting <br />properties on Bryan Street, the project petitioner and the railroad should be assessed <br />those costs. The following table outlines the assessable amounts for each of the <br />aforementioned options for the Railroad and Jim Boss. <br />Upon Council determination of the assessment method the corresponding declaration of <br />costs resolution shou d be approved.
