Mr. Gerald Urban <br />Page 2 <br />• Council members may be held personally liable for unauthorized disbursement of city <br />money. In short, you can only expend city money to pay a legal claim. After six years, <br />the claim is no longer lawful. <br />• Equity cannot enter into a city payment of a claim that has no legal standing. <br />If, as we believe, the six -year statute of limitations applies, then the city can not "gift" to Little <br />Canada, more than the amount due within the six -year period, A city can not give away public <br />money. In fact, the Attorney General ruled long ago that a municipality had no power to give <br />away its property without consideration, even after a favorable vote of the electors.
