meeting. The City Council shall request the City <br />Administrator to set a date for a public hearing. Notice of <br />such hearing shall be published in the official newspaper <br />at least ten (10) days prior to said hearing, and individual <br />notices shall be mailed not less than ten (10) days nor <br />more than thirty (30) days prior to the hearing to all <br />owners of property within three hundred fifty (350) feet <br />of the parcel included * in the request. A list of all such <br />owners shall be provided from City records. <br />(j) Failure of a property owner to receive said notice shall not <br />invalidate any such proceedings as set forth within this <br />Ordinance. <br />(k) Upon receiving the report and recommendation of the <br />Planning Commission and City staff, the City Council <br />shall make a recorded finding of fact and impose any <br />condition it considers necessary to protect the public <br />health, safety and welfare. <br />(I) The City Council shall decide whether to approve or deny a <br />request for a variance or an appeal within thirty (30) days <br />after the public hearing on said request. <br />(m) A variance of this Subdivision Ordinance or grant of an <br />appeal shall be by majority vote of the full City Council. <br />(n) The City Administrator shall notify the originator of the <br />variance request or appeal of the City Council's decision <br />in writing. <br />(Amended: Ord. 195, Amended: Ord. 407) <br />1011. VIOLATIONS AND PENALTY <br />1011.010. MISREPRESENTATION AS TO <br />CONSTRUCTION, SUPERVISION, OR INSPECTION OF <br />IMPROVEMENTS. It shall be unlawful for any person, firm or <br />corporation owning an addition or subdivision of land within the City to <br />represent that any improvement upon any of the streets, alleys or <br />avenues of said addition or subdivision or any sewer in said addition or <br />subdivision has been constructed according to the plans and <br />specifications approved by the City Council, or has been supervised or <br />inspected by the City, when such improvements have not been so <br />constructed, supervised or inspected. <br />1011.020. This Ordinance shall be administered and enforced <br />by the Zoning Administrator who is appointed by the City Council.
