In the event the representation set forth above is not accurate, then the non - defaulting <br />party may terminate this Contract on 10 days written notice. Such notice must include an <br />explanation as to why that party is terminating this Contract. <br />18. Addenda and Exhibits: This Contract includes the following Addenda and /or Exhibits, <br />which shall take precedence over conflicting provisions (if any) of this Contract, and are made <br />an integral part of this Contract and fully incorporated by reference: <br />Exhibit A: Legal Description Parcels B and C <br />Exhibit B: Legal Description Parcels A, D and E <br />Exhibit C: Depiction of the Parcels <br />Exhibit D: Depiction of the roadway to be constructed by City <br />19. Replat: City and McDonald's agree that the Parcels will be replatted. City will be <br />responsible for coordinating the re -plat of the Parcels. which re -plat shall be subject to <br />McDonald's approval. McDonald's agrees to reimburse the City for a proportionate share of the <br />reasonable costs of such re- platting based on the square footage of McDonald's property <br />relative to the total square footage of the property to be re- platted calculated net of street right - <br />of -way.
