To; Dennis Unger
Cc: Scott Stevens; Zamzow, Elizabeth
Subject: FW: Oasis, Little Canada
Dennis:
The escrow held from the Oasis closing related to tank removal and clean -up should not be
released until the issue identified below is resolved.
Thanks
Joel
Original Message
From: Joel Hanson
Sent: Monday, August 20, 2007 1:17 PM
To: 'Rod Lehn'; Scott Stevens
Cc: Dan Price; Dan Larson; 'Zamzow, Elizabeth'
Subject: RE: Oasis, Little Canada
Rod:
I'm not sure this is good news. By not removing the contaminated material as I believe
was required by our purchase agreement, the buyer will need to prepare a DRAP and deal
with it at the time a new development is to move forward. I don't believe that was am
the intent of our agreement as Oasis said it would be responsible for contamination within
our defined areas. Given that contamination was encountered when the tanks were removed,
I believe that soil should have been disposed of off site and clean material placed in the
excavation.
It now appears the ultimate buyer will have to prepare a DRAP and have Oasis be
responsible for the remediation of the soils in the agreed upon areas to the extent they
are impacted by a new development - this would be to the "commercial development" standard
discussed in our Purchase Agreement.
If Oasis does not share this opinion, I would like to be advised of that at this time as
well as their rationale for their position.
Thanks
Joel
Original Message
From: Rod Lehn [mailto:rod.lehn ®liesch.com]
Sent: Monday, August 20, 2007 11:10 AM
To: Scott Stevens; Joel Hanson
Cc: Dan Price; Dan Larson
Subject: Oasis, Little Canada
Scott
l Good news, the MPCA has closed both leak numbers for the Little Canada (Rice and Hwy 36)
site. See attached closure letters. The closure
letters have also been provided to McDonalds.
Rod Lehn
Liesch Associates, Inc.
763- 489 -3171
763- 489 -3101 fax
-20-
