If the government body wishes to withhold the property from sale for a six month period it must <br />submit a written request to this office within 60 days of this notice. The written request to <br />withhold property from sale must be accompanied by a certified resolution of the governing body <br />stating the reason for the request to withhold the specific property. Anytime during the six - <br />month hold period, the municipality may acquire the parcel by use deed free of charge as long <br />as it continues to be used for the authorized public use. The county has no statutory authority to <br />allow a use deed on a parcel after the six month hold period has expired. <br />Please be advised that if your municipality fails to put the property to its stated public use after <br />three years from the date of the deed, title must be re- conveyed to the state. This rule of <br />reversion also applies when only a part of the parcel is being used for the authorized public use. <br />Governmental subdivisions may retain title to the part that continues to be used as authorized; <br />however, the title to the part that is not being used as authorized must be re- conveyed. <br />If no application is received within the six -month hold period, the property will become <br />available for public sale. Anytime during the six -month hold period or thereafter, if it has not <br />been sold at public sale, the municipality may acquire fee title to the property by payment of the <br />appraised value.
