R. I -lanxm <br />Attached is the agreement for a monument sign we entered into with RAB, LLC for 2935 Country <br />Drive. This was done in conjunction with our vacation of a portion of Country Drive last fall to <br />enable a sign to be located in this area given the limitations of the site. <br />As you will note, the agreement contemplated a monument sign. Within the past couple of weeks, <br />construction started on the sign (without a permit) and it became obvious that a monument sign was <br />not being constructed. I discussed this with Mr. Biagini and he admitted the mix -up. Apparently, a <br />new sign plan was prepared about the time we were drafting the agreement and the new plan and the <br />agreement were not reconciled. It should also be known that we had a copy of that plan in our file <br />from last fall, so this was not an overt attempt at a "bait and switch ". <br />The sign that has been constructed meets ordinance provisions. I have attached photos of the new <br />sign with landscaping. I have also attached a photo of the sign at 2925 Country Drive that will also <br />be done to resemble the new one at 2935 Country Drive. <br />I felt it was important for the Council to be aware of this situation given our agreement.. Our options <br />would be as follows: <br />1. Require the removal of the new sign and the construction of a monument sign. <br />2. Allow the new sign as constructed subject to the issuance of a building permit (it has been <br />applied for). <br />3. Same provisions as #2, except double fee the permit and require the improvement to the sign <br />at 2925 Country Drive. (This is the option I would recommend.) <br />We should also modify the agreement as necessary to reflect the sign that is approved. <br />cc: Dick Biagini <br />
