The City agrees that RAB may construct a monument sign within the <br />Utility Easement. However, such monument sign shall not interfere with, <br />hinder or otherwise compromise the City's Utility Easement. <br />RAB agrees that the construction and maintenance of such monument sizn <br />shall be at RAB's sole risk, liability and cost. RAB acknowledges and <br />agrees that the City's use of such Utility Easement may effect, disturb or <br />disrupt RAB's monument sign. Nonetheless, RAB agrees that it shall be <br />solely responsible for any and all costs relative to the monument sign, <br />including, but not limited to: maintenance; repair; damage; removal; and <br />reconstruction. <br />4. RAB agrees to defend, indemnify and hold the City harmless from and <br />against any claims, causes of action or damages which may occur relative <br />to the monument sign. <br />5.
