2580 Edgerton Street <br />Development Contract <br />[I. Completion of the detached garage structure by August 31, 2008. <br />III. Construction of a separation wall in the existing garage by April 1, 2009 to <br />ensure that total accessory space does not exceed 1,488 square feet. Said wall is <br />to reduce the usable garage space in the existing attached garage to achieve the <br />allowable square footage of accessory space. Further, the area located to the <br />north of the wall between the remaining garage space and the living area of the <br />house may not be used for storage or any accessory use. Lastly, the separated <br />space shall be converted to living space pursuant to Exhibit B and in compliance <br />with all City zoning and building code requirements. <br />IV. Completion of the conversion of the founer garage space to living space by <br />August 3, 2010 in compliance with building codes. <br />Miscellaneous <br />13. The action or inaction of City shall not constitute a waiver or amendment to the <br />provisions of this Agreement. To be binding, amendments or waivers shall be in writing, signed <br />by the parties and approved by written resolution of the City Council. City's failure to promptly <br />take legal action to enforce this Agreement shall not be a waiver or release. <br />14. This agreement shall be binding upon the parties, their heirs, successors or <br />assigns, as the case may be. <br />15. If Developer fails to complete Item II in Paragraph 12, City may contract for the <br />demolition or removal of the detached garage structure. All costs associated with said <br />demolition or removal shall be assessed to the Developer to the extent they are not fully <br />reimbursed through the financial security referenced in Paragraph 9. Costs to be reimbursed <br />shall include, but not be limited to, any contractor, legal, consultant, or administrative fees <br />associated with completion of the work. <br />16. Developer hereby grants City, its agents and employees, a license to enter any of <br />Developer's property to perform all necessary work, maintenance and /or inspections deemed <br />appropriate by the City during the construction of the Required Improvements or to allow the <br />
