Hanson, City Administrator <br />DATE: August 3, 2007 <br />RE: Valor Property Purchase Update <br />We approved a purchase agreement with Valor Enterprises, Inc. on July 11t1i. Pursuant to the terms of <br />that agreement, we are to close on the property by August 15th. We also had 30 days to complete soils <br />and environmental testing. Finally, we have 10 days from the receipt of title evidence to object to any <br />marketability issues. (Title work was received on July 25`h.) <br />The City Attorney and I have reviewed the title work (attached) and found there is nothing to object to <br />in terms of marketability, subject to the items identified in the title work. However, closer examination <br />has indicated some potential conflicts with easements on the property. On the west side, St. Paul <br />Regional Water Services has an easement that takes up the west 60 feet. (I have noted the location on <br />the attached map.) This easement could impact our usage of the property, especially if the ponding area <br />we assume will be needed needs to be moved off of the easement area. I will obtain SPRWS's position <br />on this prior to Wednesday's meeting. There also appears to be a 20 -foot easement on the north side of <br />the property that I believe belongs to Xcel for power transmission lines. (Indicated by the dashed line <br />I've drawn on the attached map.) There is also a 20 -foot MCES sewer easement along the road, but that <br />should not create any impacts given setback requirements. Staff will review both of these issues in <br />terms of site utilization and report on the outcome at Wednesday's meeting. <br />We have also completed soil borings and the report is attached. The soils will need substantial <br />corrections to accommodate a building that complies with City Codes and that can accommodate our <br />needs. I will have the City Engineer review this in greater detail and prepare an estimate of costs to <br />address the correction issues in time for your consideration Wednesday night. (Given that the report <br />was received late Thursday afternoon, I did not have time to get it in this agenda.) There is also some <br />environmental testing result on a couple of the boring samples that won't be available until early next <br />week. <br />Once all of the information is received, we will need to decide if we are to move forward with the <br />purchase or not. <br />cc: Pat Sweeney <br />Lee Elfering <br />Bill Dircks <br />
