AN ORDINANCE ESTABLISHING A FEE FOR RE- INSPECTIONS OF <br />PROPERTY WITHIN THE CITY FOR COMPLIANCE WITH THE FIRE CODE. <br />THE CITY COUNCIL OF THE CITY OF LITTLE CANADA, MINNESOTA <br />ORDAINS: <br />Section 1 <br />1. Purpose. The City of Little Canada adopts and enforces the Minnesota State Fire Code <br />for all property within the City. The City does not impose a specific charge for fire code <br />inspections conducted by the City's Fire Marshal or the Fire Marshall's designee. <br />However, the incidence of multiple re- inspections has increased in recent years, and the <br />cost of the re- inspections is detracting from the City's ability to prevent and control fires <br />through Fire Code compliance. <br />2. Basic Inspection. After a property is notified of the need for a Fire Code inspection, or <br />requests a Fire Code inspection, the Fire Marshal will conduct an initial inspection of the <br />property, and one re- inspection if deficiencies are identified. <br />3. Fee for repeated re- inspection. For each re- inspection of a property required to resolve <br />a noted Fire Code deficiency remaining after the basic inspection is complete, the City <br />shall charge a fee of $100.00. <br />4. Assessment of unpaid charges. An unpaid fire re- inspection fee may be collected <br />through special assessment of the property, to be included on the assessment roll for all <br />other unpaid special charges annually assessed by the City. <br />5. Severability. Should any section, subdivision, clause or other provision of this <br />Ordinance be held to be invalid by any court of competent jurisdiction, such decision <br />shall not affect the validity of the Ordinance as a whole, or of any part thereof, other than <br />the part held to be invalid. <br />Section 2 <br />SUMMARY PUBLICATION. Pursuant to Minnesota Statutes Section 412.191, in the <br />case of a lengthy ordinance, a summary may be published. While a copy of the entire <br />ordinance is available without cost at the office of the City Clerk, the following summary <br />is approved by the City Council and shall be published in Lieu of publishing the entire <br />ordinance: <br />This ordinance establishes a fee of' $100 for each Fire Code inspection after the <br />initial re- inspection of a property to resolve code violations. Unpaid re- inspection <br />fees may be assessed against the property and collected with property taxes. <br />8 <br />
