Heritage Office Park <br />PUD Agreement <br />NOW THEREFORE, the City and Developer agree as follows: <br />1. The garage structure shall be for the exclusive use of the owners and occupants of <br />condominium units in Heritage Office Park, whether the garage is owned by Developer or units <br />of ownership are assigned to individual condominium units. <br />2. Ownership of any unit of the accessory garage must be under common title with <br />one of the condominium units within the Heritage Office Park, or held by the Developer in <br />common to all owners of condominium units. <br />3. Ownership interests in the accessory garage may be conveyed to present owners of <br />condominium units in Heritage Office Park. Once conveyed, the Developer is responsible for <br />ensuring that the conveyed interest in the garage is combined with the owner's title to the <br />respective condominium unit and duly recorded at the Ramsey County Recorder's Office. <br />4. An ownership interest in the accessory garage may not be separately conveyed to <br />any party other than a current owner of a condominium unit in Heritage Office Park, or the <br />Developer. The Developer is responsible for ensuring that the terms of the original conveyance <br />of any interest in the garage restrict conveyance of the garage unit separately from the primary <br />condominium unit, except to sell the interest back to the Developer. <br />5. The Developer is responsible, after any conveyance of ownership interests in the <br />garage, to ensure that the Ramsey County Assessor's Office is made aware of the conveyance, <br />and shall take any steps necessary to ensure that the garage interest is properly identified as part <br />of the interest in the primary condominium unit. <br />6. The Developer shall record this PUD Agreement with Ramsey County subsequent <br />to the recording of the Plat and shall forward confirmation of the recording of the document to <br />the City. In the event that technical or clerical revisions are needed in the document or if for any <br />reason the County Recorder deems the PUD Agreement unrecordable, the Developer shall <br />cooperate with the City in the execution or amendment of any revised PUD Agreement. <br />7. This PUD Agreement cannot be assigned or transferred without prior written <br />approval of the City. <br />3 <br />
