Contingency: <br />Tenant shall be responsible to pay for its own utilities, gas, electric, telephones <br />over and above the rent and operating expenses. Tenant will also be <br />responsible for maintaining the heating and cooling units at its own expense. <br />The Landlord shall deliver the space in its present "as is" condition. <br />The Tenant shall complete all work necessary for Tenant's specific use except <br />for that work defined under Landlord work. Tenant's work shall be outlined <br />and included as an exhibit in the Lease Agreement. All plans must be <br />approved by Landlord prior to the commencement of construction. <br />None. <br />Tenant must submit its signage to the Landlord for approval. All signage must <br />meet the sign criteria established for the center and must comply with city <br />ordinances. <br />Tenant will be allowed an early teiinination option. The option is available after <br />year one (1), with sixty (60) days prior written notice and with the payment to <br />Landlord of the early termination penalty as follows. If the early termination <br />option is exercised in year 2 the penalty will be equal to three (3) months gross <br />rent. If the early termination option is exercised in year 3 the penalty will be <br />equal to two (2) months gross rent. If the early termination option is exercised in <br />years 4 or 5 the penalty will be equal to one (1) months gross rent. The penalty is <br />payable upon notice to Landlord of intent to exercise said option. <br />One Month's gross rent. <br />Please respond by Wednesday October 17, 2007 to this Request For proposal. <br />The Landlord understands that the Tenant signing a lease at Thunder Bay <br />Plaza is contingent upon Tenant receiving necessary governmental approvals <br />from the city of Little Canada regarding the operation of Tenant's massage <br />business in conjunction with the sales and manufacturing of Tenant's natural <br />soaps, lotions and essential oils. Tenant will work diligently with the city of <br />Little Canada to obtain such approvals. <br />This proposal covers the business items of importance at this time and contingent upon space availability.
