Ordinance item "B" <br />That the granting of the variance will not be detrimental to the public health, welfare, or <br />injurious to the other properties in the territory in which the property is situated. <br />Response to item `B" <br />The granting of this variance does absolutely no derogatory damage in any way stated <br />above to the residence or their properties. If anything, it will have a positive impact on <br />the properties values, which would now be deemed as "developable" parcels. <br />Furthermore, the potential shared utility partnership between Maplewood and Little <br />Canada could only benefit all those affected, including the City of Little Canada. <br />Ordinance item "C" <br />That the variance is to correct inequities resulting from an extreme hardship limited to <br />topography, soils, and other physical factors of the land. <br />Response to item "C" <br />As stated before, this property contains some very unique physical characteristics <br />pertaining to topography, grade changes, wetland locations, etc. This variance will <br />correct those inequities by allowing for connections to East and West properties which <br />would not otherwise be possible under the strict application of this provision. <br />For example, the location of the stub road to the Himmelbach property located directly <br />East of our property, would not be possible at a location consistent with a 500' cul -de- <br />sac, due to the extreme topographic / grade changes, as well as the existence of a large <br />wetland area on the Himmelbach property. The granting of this variance allows for the <br />stub to be located in an area that is actually feasible. <br />7) We believe that the City is in favor of the road length, without a formal process of the <br />variance. However, due to allegations made that if the City were to approve our Plat <br />without the approval of a variance, that a legal action would be commenced, we have <br />decided to request this variance to make the process official in nature. We do not want <br />the City, nor ourselves to be involved in a lawsuit, due to the simple fact that procedural <br />protocol was challenged by an obvious opponent of the development. <br />P.O.
