1004. PROCEDURES FOR FILING AND REVIEW <br />1004.010. SKETCH PLAN. In order to insure that all applicants are informed of the <br />procedural requirements and minimum standards of this Ordinance and the requirements or <br />limitations imposed by other City Ordinances or plans prior to the development of a preliminary <br />plat, all applicants shall present a sketch plan to the City Administrator prior to tiling a <br />preliminary plat. <br />1004.011. DEVELOPER'S COSTS. The developer shall pay to the City all expenses incurred <br />by the City relative to the subdivision, whether by plat, registered land survey, or otherwise, <br />which expenses shall include, but not be limited to, expenses for engineering, planning, fiscal, <br />administrative, and legal services. If said expenses are not paid within reasonable time after <br />billing by the City, the City shall certify the same as unpaid against the real property and shall <br />collect the same in the same manner as real estate taxes are collected. The City shall have the <br />option to collect said amounts in a civil action in lieu of certification for collection. <br />1004.020. PRELIMINARY PLAT. <br />(a) Filing. Five (5) full size copies, one reduced copy no larger than 11" by 17 ", and one <br />electronic digital file copy of the preliminary plat and a list of names and <br />addresses of the owners of property located within three hundred fifty (350) feet <br />of the subject property, accompanied by an abstractor's certificate *, shall be <br />submitted to the City Administrator. The required filing fee as established by City <br />Council resolution shall be paid and any necessary applications for variances from <br />the provisions of this Ordinance shall be submitted with the required fee. The <br />proposed plat shall be placed on the agenda of the next regularly scheduled <br />Planning Commission meeting occurring after ten (10) seventeen (17) days from <br />the date of submission. The plan shall be considered as being officially submitted <br />when all the information requirements are complied with. <br />*Note: When the properties surrounding the subject property include townhouse <br />or condominium development, the applicant may submit a mailing list of property <br />owners obtained from the managers or homeowners association of the townhouse <br />or condominium development. <br />(b) Technical Assistance Reports. The City Administrator shall instruct the appropriate <br />staff persons to prepare technical reports where appropriate, and provide general <br />assistance in preparing a recommendation to the City Council. <br />(c) Review by Other Commissions or Jurisdictions. The City Administrator shall refer <br />copies of the preliminary plat to the Park Board, Watershed District, County, <br />Metropolitan, State or other public jurisdictions for their review and comment, <br />where appropriate and when required. <br />(d) Planning Commission Action. The Planning Commission shall make a <br />recommendation to the City Council. If the Planning Commission has not acted <br />upon the preliminary plat within sixty (60) days from the first meeting at which <br />the request was received, the Council may act on the preliminary plat without the <br />Planning Commission's recommendation. <br />(e) City Council Action. <br />-10- <br />
