Use Permit subject to the provisions of Section 921 of the Zoning Ordinance. When a <br />Conditional Use Permit is issued to exceed one thousand (1,000) square feet of garage and <br />accessory building area, the parcel shall not be eligible for a detached garden shed as otherwise <br />permitted by Section 903.020.D.5.a.iii. Any existing such sheds must be removed as a condition <br />of the Conditional Use Permit. <br />6. Outdoor swimming pools with a capacity of fifteen hundred (1,500) gallons or <br />with a depth of three (3) feet or more of water shall be fenced in compliance with F, 6. of this <br />Section. <br />7. Every single family dwelling unit erected after the effective date of this <br />Ordinance shall be so located on a lot that at least a two (2) car garage, either attached or <br />detached, can be located on said lot. <br />8. No accessory uses or equipment which generate noise such as air conditioning <br />units or condensers, generators, swimming pools, and the like shall be located in a required side <br />yard of a residential use or a use abutting a residential district. <br />Figure 903 -1 <br />E. Drainage Plans. In the case of all multiple family, business and industrial <br />developments, the drainage plans shall be submitted to the City Engineer for his review and the <br />final drainage plan shall be subject to his written approval. <br />F. Fences - General Requirements. <br />1. Permit Required. No persons, firm, or corporation shall construct or erect any <br />fence without first securing a permit. <br />2. Location. All boundary line fences shall be located entirely upon the private <br />property of the person, firm or corporation constructing, or causing the construction of, such <br />fence, unless the owner of the adjoining property agrees, in writing, that such fence may be <br />erected on the division line of the respective properties. See Figure 903 -2. <br />3. Surveys. <br />Surveyor. An applicant for a fence permit shall , be required to verafg the location o f existing <br />property lines either by location of the property line comers or submission of a. survey conducted <br />by a Registered Land Surveyor. The City ;Building Official shall, pursuant to a, fence permit <br />application, inspect the location and construction of any fence both.prior to and after <br />construction. <br />-64- <br />
