they do, they cannot claim that the products are for smoking tobacco. This is <br />clearly within the City's authority, as Minn. Stat. § 461.12 authorizes local <br />regulation of "the retail sale of tobacco and tobacco - related devices." <br />The display area limitation aims to limit the appeal of Little Canada <br />tobacco stores to customers not interested in tobacco, through a physical <br />limitation of how much merchandise can be displayed at any given time. The <br />limitation percentage is intended to be a reasonable figure which respects the <br />typical display needs of a tobacco - focused shop. An alternative would be to use a <br />gross sales restriction (verified in records at renewal time) in place of the physical <br />restriction (checked by deputies or city officials in inspections). The Tobacco <br />Store license already requires proof that 90% of gross revenue comes from <br />tobacco and tobacco devices. In creating the Tobacco Store license classification, <br />the City can establish the additional requirement that at least 50% (or another <br />reasonable percentage) of gross revenue come from tobacco sales.
